Terms of Sale
Contract of Sale Our website presents our goods and does not constitute a contractual offer to sell goods. Orders submitted through our order processing app may be subject to cancellation without cause, however we will endeavour to provide cause immediately. The order process will be set out on the order processing website and will allow for you to review the order. It is your responsibility to ensure information has been input accurately. A sale of goods contract will be formed upon you receipt of an email from Dusk Carnival confirming your order. Ensure that that the order confirmation is complete and free of errors, and advise us if this is not so. We will not be held responsible for any errors in the order placed by you. Upon entering into contract, no variations will be permitted unless agreed by the customer and Dusk Carnival in writing. Price and Payment The price of the goods and any other charges are set out on the website at the date of order. Payment of goods and applicable charges shall be remitted by debit or credit card through the Stripe payment platform. Collection of goods The goods will be delivered to you with in the agreed timeframe. A delivery location will be agreed with you when available, this will be an address in the United Kingdom. We would ask that the the nominated collector obtain a physical ID when coming to collect the goods, the details would need to match those instructed under the specific order in the Order processing platform. We will endeavour to remedy if there is failure in us delivering the specified timeframe. Withdrawal, returns abd cancellation You can withdraw your order prior to the contract being made, without reason and without incurring any liability. The contract formed is a distance contract which is subjects to cancellation rights. These rights are however not applicable if the order is made to your specifications or personalised. Right to cancel Subject to these Terms and Conditions, you can cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party, other than the carrier indicated by you, acquires physical possession of the last of the Goods. In a contract for the supply of goods over time (ie subscriptions), the right to cancel will be 14 days after the first delivery. To excercise your right to cancel, you may write a letter or email informing us of your decision to cancel this contract. You must retain any evidence that confirms when the the cancellation was made. If we have offered to collect the goods or if no goods were supplied, we will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to cancel this contract. Conformity It is our legal duty to supply the goods in confirmity with the contract, and we will not have conformed if it does not meet this requirement. Upon delivery the goods will: a) conform to their description. b) be of satisfactory quality; c) be reasonably fit for purpose for which the goods were intended before the contract is made, or we were informed by you and be fit for purposed as intended by us as per this contract. Succession The benefit of this contract is transferrable to someone else by either party, and will remail liable to the other for its obligations under the contract. The Supplier will be liable for the acts of those it enlists to perform its duties. In the event that failure is resulted by factors beyond reasonable control by either party; a) the party will advise the other party as soon as practicably possible and the other party's obligations will suspended so far as reasonable, provided that the party will act reasonably and that the other party will not be liable for any failure that could be reasonably avoided.
